Thank you for your interest in The Spud Wellness Club
Your membership will be governed by these terms – they will be between you, as the member, and Spud.ca. The Spud.ca Privacy Policy (https://about.spud.com/privacy-policy/) governs how we will treat your information. There may be other applicable terms, conditions, limitations and requirements depending on where you are located and what you are purchasing. Finally, there may be applicable terms related to any promotional offers provided to you for use with The Spud Wellness Club membership. When you purchase or use your issued Spud Wellness Club membership, you accept this relationship and these terms. We may make changes at any time, in our discretion and without notice, to these Terms or we may terminate The Spud Wellness membership. If we make material changes or terminate The Spud Wellness club, we will notify you by email and/or post the new terms at www.Spud.ca/
The Spud Wellness Club Discount
As a member of The Spud Wellness Club, upon your purchase of a Spud Wellness club membership for $30, you will receive 15% off regular priced eligible purchases. Your Spud Wellness Club membership will expire in one year, ending on the one year anniversary from which you purchased your Club membership. Eligible purchases are: nutritional supplements, homeopathy, protein powders and herbal powders, body care, cosmetics. The discount is based upon the posted regular price for the item. Other discounts or promotions will not be combined with this offer.
Non-Qualifying Purchases
The Spud Wellness Club membership discount does not apply to hairbrushes, toothbrushes, makeup applicators, sponges, razors, neti pots, spa tools, cotton products, whole foods and snacks, sweeteners, spices, coconut oil, ghee, meal replacement or protein bars, seasonal or holiday products, candles and candle accessories, diffusers, salt lamps and salt lamp accessories. Purchases made with a gift card are eligible for benefits. Other exclusions may apply.
Participation
The Spud Wellness Club is currently offered at all Spud.ca locations in Calgary and Vancouver as well as Blush Lane locations in Alberta, excluding the Calgary Farmers Market location. You can sign up at all participating stores. Participating stores are subject to change or terminate the club at anytime.
Eligibility
The Spud Wellness Club participation is available to all qualifying individuals 18 years of age and over.
E-Mail
You must provide and maintain a valid e-mail address and promptly update your account with any changes. You acknowledge that Spud.ca will communicate with you about club changes and promotional materials through this e-mail address. By signing up for The Spud Wellness Club, you are agreeing to receive promotion emails from Spud.ca. You may opt out of promotional emails at any time.
Limitations
You may not transfer or assign your issued Spud Wellness membership or benefits. Spud Wellness Club memberships have no cash value and may not be transferred. Additional restrictions may apply to Spud.ca team members.
Membership Cancellation
You may cancel your membership of the Spud Wellness Club within the first 14 days for a full refund of your membership fee minus the discount amount that was applied to any purchases made with your Spud Wellness Club membership. Call Spud customer care, or bring your receipt to the customer service till at the store where you purchased your Wellness Club membership. We reserve the right to terminate your issued Spud Wellness Club membership because of conduct that we determine, in our discretion, violates these Terms or any applicable law, involves fraud or misuse of your Spud Wellness Club membership or benefits, or is harmful to our interests or another customer. We also reserve the right to deny future membership if we deem your conduct to violate these Terms. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights. We reserve the right to terminate or continue the Spud Wellness Club at any time. In the event we terminate the Spud Wellness club prior to the expiration of your issued Spud Wellness Club membership, you may request a pro-rata refund from a participating location of the amount paid for your issued Spud Wellness Club membership for up to three (3) months after the effective date of such termination. The pro-rata amount will be based upon the period for which you were a member. If the Spud Wellness club is still in effect at the time your Spud Wellness Club membership expires and you wish to continue as a member of the club, you must pay an annual renewal fee.

General Club Information
We may, in our discretion and at any time, change these Terms, Spud.ca Privacy Policy and Terms or any aspect of the Spud Wellness club. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. Your continued membership after we change these terms constitutes your acceptance of the changes. If you do not agree to any changes, you must cancel your membership. The Spud Wellness club and the content, logos, taglines, and trademarks are the intellectual property of Spud.ca and licensed under controlled conditions. The Spud Wellness Club terms are void where and to the extent prohibited by law. Taxes may apply where required by law.
Limitation of Liability
In addition to other limitations and exclusions in Spud.ca terms of use and to the extent not prohibited by applicable law, under no circumstances will we or our directors, officers, employees, agents or other representatives or any Spud.ca parties be liable for any direct, indirect, special, incidental, consequential, or punitive damages, or any other damages of any kind, arising out of or related to the club. Our total liability, whether in contract, warranty, tort (including negligence) or otherwise, will not exceed the total amount you spent on qualifying purchases in the most recent twelve-month period. These exclusions and limitations of liability will apply to the fullest extent permitted by law and will survive cancellation or termination of your membership. Applicable law may not allow the limitation of liability set forth above, so this limitation of liability may not apply to you, and you may have rights additional to those contained herein. This is a comprehensive limitation of liability that applies to all losses and damages of any kind (including personal injury or death or for any direct, indirect, economic, general, special, punitive, incidental, exemplary or consequential damages of any kind, including without limitation, loss of data, income, or profits, in connection with, or otherwise directly or indirectly related to, without limitation, the club or other Spud.ca products or services, even if Spud.ca has been advised of or should have known of the possibility of such damages regardless of whether you bring an action based in contract, negligence, strict liability, or tort (including whether caused, in whole or in part, by negligence, acts of god, telecommunications failure, or destruction of the service). Each provision of these terms & conditions that provides for a limitation of liability, disclaimer of warranties, or exclusion of damages is to allocate the risks under the agreement between you and Spud.ca. This allocation is an essential element of the basis of the bargain between you and Spud.ca. The limitations in this section will apply even if any limited remedy fails of its essential purpose(s). If you are dissatisfied with the club or these Terms & Conditions, your sole and exclusive remedy is to terminate your membership. You acknowledge, by your participation in the club, that your participation is at your sole risk. Notwithstanding the foregoing, this section does not expand or limit (i) any express, written product warranty or related disclaimers that are provided by Spud.ca parties or their suppliers with regard to a physical product sold by Spud.ca parties to you, or any warranty on a physical product to the extent required by applicable law; (ii) Spud.ca parties’ liability for personal injury to you caused by Spud.ca parties to the extent not waivable under applicable law; or (iii) any cause of action you may have against Spud.ca parties that is not waivable under applicable law.
Waiver of Injunctive or Other Equitable Relief
To the fullest extent not prohibited by applicable law, if you claim that you have incurred any loss, damages, or injuries in connection with your use of the service, then the losses, damages, and injuries will not be deemed irreparable or sufficient to entitle you to an injunction or to other equitable relief of any kind. This means that, in connection with your claim, you agree that you will not seek, and that you will not be permitted to obtain, any court or other action that may interfere with or prevent the development or exploitation of any website, application, content, user-generated content, product, service, or intellectual property owned, licensed, used or controlled by Spud.ca or a Licensor of Spud.ca.
Resellers
Resellers are excluded from the club and from receiving the discount. If we mistakenly issue membership to a reseller, we reserve the right to terminate such membership and issue a pro-rata refund of the membership fee.
